Courts say Viva Aerobus baggage-free fare is legal

Mexican airline Viva Aerobus informed this Wednesday that, according to the ruling issued by the competent Federal Courts, the Zero Fare is, in its entirety, attached to what is stipulated by the Civil Aviation Law.

“Aware of the diverse needs and profiles of passengers, it offers four travel modes that include different numbers of suitcases, of different weights and sizes. In this way, the airline is able to provide its passengers with significant discounts, to the benefit of their economy, when they do not wish to carry a certain amount of luggage. This gives them freedom and the right of choice to avoid unnecessary payments for services they do not require,” said Viva.

In this regard, the airline explained that its base or standard fare is Viva Smart, which includes two carry-on bags totaling up to 15 kilograms and 25 kilograms of checked baggage, in full compliance with the baggage allowance established in the Civil Aviation Law.

In addition to this standard fare, Viva offers three preferential fares – Zero, Light and Extra – for those traveling light in accordance with Chapter X Bis of the rights and obligations of passengers, Article 47 Bis, Section X: “In the event that the passenger decides to travel without baggage, the concessionaire or permit holder may offer a preferential fare for the benefit of the passenger”. Specifically, the Zero Fare includes a personal item, whose measurements do not exceed 35x45x20 centimeters, such as a handbag or backpack.

This resolution in favor of the airline is the result of an injunction filed by Viva Aerobus, due to the alert issued by the Federal Consumer Protection Agency (PROFECO) on December 1, 2021, whose interpretation of the Civil Aviation Law differed with what was offered by Tarifa Zero. In this regard, according to the ruling of the judicial authority, it was determined that passengers can access such preferential rates whether they decide to waive their right to carry carry-on baggage or checked baggage. Therefore, after this resolution, such alert is without effect and all passengers will be able to continue enjoying the advantages of traveling light and saving more with this type of travel modalities.
