Colombia: Aerocivil admits other airlines in Avianca-Viva Air integration process

The Civil Aeronautics of Colombia (Aerocivil) through resolution admits the intervention of other airlines, which are interested in the integration process of Avianca with Viva Air.

The Aerocivil through resolution number 349 of February 24, 2023, admits the intervention of third parties in this integration process of Avianca and Viva Air airlines.

The entity with this determination communicates this decision to the intervening companies Avianca, Ultra Air, JetSmart.

For the entity, it is clear that the third party petitioners have demonstrated their interest in this administrative action and the companies themselves have recognized that as a consequence of the projected operation, harmful effects will be generated to the markets in which they participate.

The Aerocivil announced that it is continuing with the process and awaits the opinion of the Supertransporte, as inspection and surveillance authority, while it studies arguments of third parties and evaluates the conditions proposed by the intervening parties.

In the document, it stated that it is awaiting the pronouncement of the Superintendence of Transportation, as an entity to exercise control and surveillance and thus provide useful elements for the analysis of the projected operation.

According to the Aerocivil’s Air Transport and Aerocommercial Affairs Directorate, no appeal may be filed against this decision.
