The Civil Aeronautics of Colombia (Aerocivil), in a new resolution, confirmed the integration of Avianca and Viva Air airlines and modified some of the conditions it had issued in the resolution of last March 21
“The Secretariat of Aeronautical Authority issued Resolution 00873 of May 5, 2023 by which it resolves in second instance the appeals filed by the airlines Avianca, Viva Air, Wingo, Ultra Air, Latam, JetSmart and the Attorney General’s Office, against Resolution 00518 of March 21, 2023, confirming the approval of the integration operation, and modifying some of the conditions determined for it”, said Aerocivil in a statement.

These were the conditions set forth in the Resolution:
- That the rights of Viva Air users be respected and attended to; that tickets for cancelled flights be reimbursed or that those with reservations and tickets pending execution be allowed to fly.
- The return of departure and arrival slots, adjusting them in such a way that the infrastructure of El Dorado International Airport is used more efficiently, guaranteeing competitive conditions and allowing the permanence of Viva Air.
- Maintain Viva Air’s “low cost” scheme as an option that offers alternatives to air transportation service users, especially on those routes that were only operated by Viva Air.
- The return of frequencies on the Bogota – Buenos Aires route if required, which is particularly impacted by the transaction, ensuring the rights of passengers and without affecting the supply of seats, opening the possibility to other operators, when there are expressions of interest.
From the date of issuance of the new resolution, May 5, 2023, Viva Air and Avianca will have five calendar days to communicate to the country, users and the aeronautical authority their final decision on whether or not to implement the integration.
